What Is an ITIN?

An Individual Taxpayer Identification Number (ITIN) is a nine-digit taxpayer identification number issued by the IRS to individuals who need a U.S. taxpayer identification number for federal tax purposes but are not eligible for a Social Security Number. ITINs are formatted like an SSN and begin with the number 9.

An ITIN is for federal tax administration. It does not authorize employment in the United States, change immigration status, or create eligibility for Social Security benefits.

If you are eligible for an SSN, Form W-7 is generally not the correct path. The ITIN program is for people who need a taxpayer ID for federal tax purposes but cannot obtain an SSN.

Who Actually Needs an ITIN?

The correct test has two parts: (1) you have a federal tax purpose that requires a taxpayer identification number, and (2) you are not eligible for an SSN. Current Form W-7 categories include nonresident aliens claiming treaty benefits, nonresident aliens filing U.S. federal returns, certain resident aliens filing U.S. returns, and qualifying spouses/dependents, among other specified situations.

Do not assume a CAA can authenticate every dependent document. CAAs can authenticate most documents for primary/secondary applicants, but for dependents they generally authenticate only passports and birth certificates; foreign military ID and certain dependent records must be handled under the IRS's special rules.

CAA or Acceptance Agent

No single route is always “best.” A CAA can be particularly useful when you are abroad or want to avoid mailing an original passport, but a designated TAC or qualifying VITA ITIN site can provide free alternatives when accessible.

If you mailed supporting documents, the IRS says it will return them to the mailing address on Line 2 of Form W-7 within 60 days. Contact the IRS if the documents have not returned by then.

ITIN Expiration and Renewal

An ITIN expires if it is not used on a U.S. federal tax return for three consecutive tax years. It expires on December 31 after the third consecutive year of non-use.

You generally renew an expired ITIN when it will be included on a federal tax return. If an expired ITIN is only being used on information returns reporting payments, such as certain Forms 1099, the IRS says renewal is not required solely for that use.

Do not renew an ITIN if you obtained an SSN. Follow IRS instructions for notifying the agency and use the SSN going forward.

ITIN vs EIN for LLC Owners

An ITIN identifies you as an individual taxpayer; an EIN identifies the business or entity. You do not need an ITIN merely to form a U.S. LLC. And current Form SS-4 instructions permit a foreign responsible party who has no SSN/ITIN and is ineligible for either to enter “foreign” or “N/A” on Line 7b when applying through the applicable EIN route.

Common ITIN Application Mistakes

  • Applying even though you are SSN-eligible. Confirm SSN eligibility first.
  • Applying only because you own an LLC. LLC ownership alone does not create ITIN eligibility.
  • Omitting the federal return without a valid exception. Most first-time W-7 applications require a return.
  • Using an unsupported exception. Match the exact W-7 exception and evidence requirements.
  • Sending ordinary photocopies. The IRS generally requires originals or issuing-agency-certified copies unless an authorized authentication route applies.
  • Assuming a passport always resolves every dependent case. Date-of-entry/residency and dependent rules can require more.
  • Confusing an AA with a CAA. Only a Certifying Acceptance Agent can authenticate most qualifying documents.
  • Using old mailing addresses. Check current IRS instructions before mailing.
  • Paying a provider because you think the IRS charges for the ITIN. The IRS issuance itself is free; third-party help can have separate fees.
