LLC Formation Service FAQ

Formation companies can make an LLC filing easier, but they are optional intermediaries—not the state and not a substitute for individualized legal advice. This guide answers the questions that matter before you pay: what a service actually does, what “$0” means, which add-ons are optional, and when DIY filing or an attorney is the better route.

Direct Answer

Do you need an LLC formation service?

No. You can form an LLC directly with the appropriate state filing office. A formation service is mainly a convenience layer that prepares and submits standardized paperwork and may sell registered-agent, EIN, compliance and document services. Use one when the convenience is worth the cost; use an attorney when your situation requires individualized legal advice.

What Formation Services Actually Do

A formation service sits between you and the state filing office. For a straightforward LLC, its core job is usually administrative: collect your information, prepare the state formation document, submit it, and return the approved filing or state confirmation to you.

A standardized filing platform does not replace individualized advice on ownership rights, contracts, tax strategy or regulated-profession rules.

Are “$0 LLC Formation” Plans Really Free?

A provider can legitimately charge a $0 base service fee for preparing the formation filing. That does not mean the LLC itself costs $0 to create. You still pay mandatory state filing charges, and optional products can materially change the checkout total and future renewal cost.

Compare the renewal column. Registered-agent service, compliance subscriptions, business-address products and other recurring services can matter more than the first-day headline price.

Who Controls Formation Speed and Approval?

The formation company can control how quickly it reviews and submits your order. The state filing office controls final acceptance and much of the processing timeline. Optional state expedited processing may exist in some jurisdictions, while provider “rush” handling can be a separate service.

No formation company can guarantee state approval. A state can reject a filing because of an unavailable name, missing information, statutory restrictions or another filing defect.

What Happens After the LLC Is Formed?

Formation is only the beginning. Depending on the LLC and state, next steps can include obtaining an EIN, creating an operating agreement, opening a business bank account, obtaining licenses, registering for taxes, maintaining a registered agent and meeting annual or biennial reporting requirements.

The IRS currently states that eligible applicants can obtain an EIN free directly from the IRS, and that a legal entity such as an LLC should be formed with the state before applying for its EIN.

Formation Service vs. Attorney

A formation service is strongest when the job is standardized paperwork. An attorney becomes more valuable when the formation itself involves legal judgment—for example, unequal member contributions, investor rights, vesting, complex management powers, regulated professional ownership, unusual asset-protection planning or negotiated operating-agreement terms.

Do not buy convenience as a substitute for advice you actually need. If a decision could materially affect ownership rights, liability, taxation or regulatory eligibility, the lowest-cost filing path may not be the best path.

15 LLC Formation Service Questions Answered

No formation service is legally required. You can file directly with the state yourself. A service mainly adds convenience, guided preparation, document handling and optional add-ons.
A $0 service-fee offer can mean the provider charges no base preparation fee, but you still pay mandatory state filing fees. Optional services, subscriptions, registered-agent service, EIN help and other add-ons may cost extra, so review the checkout total and renewal terms.
There is no single standard price. Some providers advertise a $0 base service fee plus state fees, while paid packages and add-ons vary widely. Compare the total first-year cost and recurring renewals, not only the headline formation price.
The state—not the formation company—ultimately controls approval timing. A provider can affect how quickly it prepares and submits your filing, while state processing and optional state expedite services determine much of the remaining timeline.
Many offer EIN application help, sometimes for an added fee. Eligible applicants can also obtain an EIN directly from the IRS for free. Form the legal entity with the state before applying for its EIN.
An LLC must satisfy its state's registered-agent requirement. A formation company may offer registered-agent service, but buying formation assistance does not itself eliminate that requirement.
Many providers offer registered-agent coverage and foreign-qualification filing assistance in multiple states. The actual legal requirements and government fees remain state-specific.
The result depends on why the filing was rejected and on the provider's current correction or guarantee policy. A service may help correct preparation errors, but the state retains final authority over acceptance.
Many sell annual-report filing, deadline reminders, registered-agent service or other compliance products. These are usually separate from the act of forming the LLC and may renew automatically, so check scope and renewal pricing.
Usually yes. Your LLC is a state-created legal entity, not an account owned by the formation provider. You can generally change registered agents or service vendors without forming a new LLC, although state filings or fees may be required for certain changes.
Many major business-formation companies support corporations and other entity types as well as LLCs. Available packages and documents vary by provider and entity.
For a straightforward filing, doing it yourself directly with the state is usually the lowest-cost route because you avoid a formation-service fee and optional add-ons. You still owe the state's required filing charges.
A formation service can be suitable for standardized administrative filing. Consider an attorney when ownership, investor rights, regulated-profession rules, tax structuring, contracts or other legal issues require individualized advice.
No provider controls the state's final decision. Review any provider guarantee carefully: it may cover the provider's own preparation or correction work, not guarantee that the state will approve the LLC.
Compare the base service fee, mandatory state fees, registered-agent pricing and renewal, included documents, EIN pricing, compliance subscriptions, cancellation terms, support quality, processing claims and whether you actually need each add-on.
